JOSEPH COBB (1832-1913) - MASTER BUTCHER & PHILANTHROPIST

THIS IS THE LAST WILL AND TESTAMENT of me JOSEPH COBB of Cromwell House Hounslow in the county of Middlesex Esquire.

1. I appoint my dear wife Emily Harriet Cobb, my friend Charles Malcolm Fisher of Hampton in the county of Middlesex Gentleman, Alfred Eborall of Lyndhurst Hayne Road Beckenham in the county of Kent Builder and William Frederick Hardy of 3 Burlington Gardens Chiswick in the county of Middlesex Coal Merchant EXECUTORS and TRUSTEES of this my will.

2. I bequeath all my plate and plated articles, linen, china, glass, books, pictures, prints, trinkets, wines, liquors, furniture and other household effects and also my carriages, horses, harness and outdoor effects unto my said wife absolutely.

3. I devise and bequeath my house and premises known as Cromwell House Hounslow aforesaid and the grounds belonging thereto to my said wife for life she insuring the same and keeping it in good repair.

4. I bequeath to my said wife a legacy of fifty thousand pounds.

5. Al1 the rest residue and remainder of my estate and effects whatsoever and wheresoever real as well as personal I give devise and bequeath unto my said executors and trustees (hereinafter called my trustees) Upon trust to sell call in and convert into money the same or such part thereof as shall not consist of ready money and out of the proceeds and with and out of my ready money in the first place to pay all the government duties which upon my decease may become payable in respect of my real and personal estate together with all my debts funeral and testamentary expenses and in the next place to pay the following legacies videlicet. To my niece Ada Mary Ratcliffe the legacy of five thousand pounds, To my cousin Joanna Williams the legacy of two thousand pounds, To my executors the sum of one thousand pounds to be laid out in the purchase of an annuity for my sister Mary Ann Phillips, To my executors the sum of five hundred pounds to be laid out in the purchase of an annuity for my niece Jessie Eleanor Phillips, To my brother in law Charles Alfred Walter a legacy of five hundred pounds, To my cousin William Frederick Hardy a legacy of five hundred pounds in addition to the legacy given to him as executor, To my cousin Annie Hardy a legacy of two hundred pounds, To Constance Symonds of Burlington Gardens a legacy of one hundred pounds, To my cousin Clara Metcalfe a legacy of one hundred pounds, To my cousin Harold Britten a legacy of one hundred pounds, To my cousin Mary Britten (Mrs Arthur Britten) a legacy of three hundred pounds, To my niece Mabel Fanny Cobb a legacy of five hundred pounds, To my niece Ethel Emma Cobb a legacy of five hundred pounds, To my nephew Arthur Saville Cobb a legacy of five hundred pounds, To my nephew William Cook a legacy of five hundred pounds, To my nephew George Andrew Walter a legacy of three hundred pounds, To my niece Ann Marion Taylor a legacy of three hundred pounds, To my niece Kate Edith Cardwell a legacy of three hundred pounds, To my niece Esther Elizabeth Walter a legacy of three hundred pounds, To my sister in law Mrs. Elizabeth Ann Ludlow the legacy of four hundred pounds, To my nephew Harry Joseph Walter a legacy of five hundred pounds, To my nephews Arthur Joseph Phillips, George John Phillips, William Hewitt Phillips and Reese Barrett Phillips a legacy of one hundred pounds each, To Mrs. Grace Edith Hardy the wife of Harry W Hardy a legacy of one hundred pounds, To the said Charles Malcolm Fisher a legacy of five hundred pounds in addition to the legacy given to him as executor, To each of my trustees other than my wife as some acknowledgment of the trouble they will have in executing the trusts of this my will a legacy of two hundred pounds each in addition to any other legacies bequeathed to them by this my will, To my gardener William Smith if in my service at my death a legacy of one hundred pounds, To my coachman Robert Spinx in the like event a legacy of one hundred pounds, To my stockman Lewis if in my service at my decease a legacy of twenty five pounds, To my executors the sum of two hundred pounds to be laid out in the purchase of an annuity for my wife's niece Emily Louise Fowler, To the vicar and churchwardens for the time being of Heston the sum of two hundred and fifty pounds to be invested and the income applied towards keeping up the churchyard at Heston And to the Butchers Charitable Institution the sum of five hundred pounds And I declare that all the aforesaid legacies and annuities shall be paid free from all death duties.

6. I declare that my trustees shall after making the payments hereinbefore directed pay and transfer the residue of my said real and personal estate and the investments for the time be representing the same to my said wife and Ada Mary Ratcliffe.

7. I declare that my said wife and the said Ada Mary Ratcliffe shall stand possessed of my residuary real and personal estate and the investments for the time being representing the same Upon trust for my said wife during her life and from and after her decease subject to the payment of five thousand pounds to my nephew George Cobb and the following legacies to charitable institutions (exclusively out of my personal estate) viz. To the United Kingdom Railway Officers and Servants Association, The Royal Agricultural Benevolent Institution, The National Benevolent Institution and the Hospital for Incurables the sum of two hundred and fifty pounds each and To the trustees of the Hounslow Hospital the sum of five hundred pounds to be invested and the income applied towards the maintenance of the hospital And subject to the payment of the last mentioned legacies and the death duties thereof to hold the ultimate residue of my estate In trust for such of my nephews and nieces and my wife's nephews and nieces in such shares and proportions and in. such manner as my said wife and the said Ada Mary Ratcliffe shall by any deed or deeds to take effect at any time either during my wife's life or at her decease jointly appoint and in default of and subject to such appointment or appointments and so far as any such appointments or appointment shall not extend In trust after payment of all death duties payable in respect of my estate to pay and divide the same unto and amongst all such of my own nephews and nieces and those of my wife as shall be living at the death of my wife in equal shares.

8. Provided always and I hereby declare that my nephews and nieces and my wife's nephews and nieces who may be appointees under the last clause shall share equally with my other nephews and nieces and my wife's other nephews and nieces in the same manner as if they had not been such appointees and shall not be required to bring their appointed share or shares into hotchpot or account for the same in any way.

9. I expressly declare that my said wife and the said Ada Mary Ratcliffe shall have power to execute as many appointments as they may consider fit under clause 7 hereof and make more than one appointment in favor of the same or other nephews and nieces as they shall in their absolute and uncontrolled discretion think fit it being my intention that my wife and the said Ada Mary Ratcliffe shall have absolute discretion to execute as many appointments as they may think fit of my residuary estate and as often as they please and to as many of my nephews and nieces and my wife's nephews and nieces as they may think fit but no such nephews and nieces shall take under the aforesaid power or powers of appointment a total sum exceeding five thousand pounds.

10. And I declare that the receipts of the respective treasurers for the time being of the hereinbefore mentioned institutions shall be sufficient discharges to my trustees.

11. And I declare that my trustees shall be at liberty during the life of my wife to postpone the sale and conversion of my real and leasehold estate or any part or parts thereof notwithstanding that the property the sale or conversion whereof shall be so postponed may be of leasehold tenure or may be otherwise of a perishable or wearing out nature or not be proper trustees securities for such periods as they in their uncontrolled discretion shall think fit and that the rents and profits of such real and personal estates or so much thereof as shall for the time being remain unsold shall after payment thereout of the expenses of management and all necessary outgoings be paid to or received by my wife in the same manner as the income of the investments of my residuary estate as hereinbefore mentioned.

12. And I declare that the power of appointing new trustees conferred by statute shall for the purposes of this my will be vested in my trustees for the time being and the survivors or survivor of them And I wish it to be understood that my reason for not making any bequest to my brothers by this my will is because they were amply provided for by the gift I made to them of my business in Sloane Street in the year one thousand eight hundred and seventy eight.

13. And hereby revoking all former wills and testamentary dispositions made by me I declare this to be my last will and testament IN WITNESS whereof I have hereunto set my hand this third day of December one thousand nine hundred and twelve - JOSEPH C0BB - Signed and acknowledged by the said Joseph Cobb as his will in the presence of us present at the same time who in his presence and in the presence of each other have hereunto subscribed our names as witnesses - Wm. On the 26th day of July 1913 Probate of this will was granted to Emily Harriet Cobb, Charles Malcolm Fisher, Alfred Eborall and William Frederick Hardy the Executors.
