LAST WILL AND TESTAMENT

IN THE NAME OF GOD AMEN

I, Hewett Cobb of Clements Inn, London and Sydenham in the County of Kent Esq., do make, publish and declare this to be my last Will and Testament in manner following.

That is to say that, after payment of my just debts, I give and bequeath unto each of my nephews and nieces, being the children of my brother George Cobb, (namely Jane Ragless, Elizabeth Cobb, Sophia Cobb, Eliza Cobb, William Cobb, Joseph Cobb and Henry Hewitt Cobb), the sum of one hundred pounds a piece. To be paid, to such of them as shall have attained the age of twenty one years, within six months next after my decease and, to such of them as shall not have attained twenty one years, when and as they shall severally and respectively attain that age. And, in case any or either of them shall happen to die before they attain that age, I give and bequeath the share of him, her or them so dying to be equally divided between and amongst the survivors or survivor of them, share and share alike.

Also I give and bequeath unto my nephew George Cobb, eldest son of my brother George Cobb, now residing with me, the full sum of four hundred pounds in trust , nevertheless that he shall and do, within six months next after my decease, lay out and invest the said last mentioned sum in the purchase of Navy 5% Bank annuities in the Bank of England in his own name and shall and do pay the clear annual interest or dividends thereof half-yearly, as the same shall from time to time become due and payable, into the proper hands of his mother Sophia Cobb, during the term of her natural life. Whose receipt alone, notwithstanding she be under coverture, shall be at all times good and sufficient discharges for the same ? interest and dividends. Nor shall the same 5% annuities or the ? interest thereof ever be subject to the debts, control or engagements of her husband, the said George Cobb, And, from and immediately after the death of the said Sophia Cobb the elder, if in the lifetime of her husband the said George Cobb, then I give the said clear annual interest and dividends of the said 5% Navy annuities unto her husband, the said George Cobb, for and during the term of his natural life to be paid half yearly.

And, from and immediately after the death of the survivor of them, the said Sophia Cobb the elder and George Cobb the elder, then I give and bequeath the whole of the said 5% Navy Annuities unto the said George Cobb the younger for his own sole use and benefit absolutely.

Also I give and bequeath unto my much esteemed friend and brother-in-law Matthew Burchell of Fulham Esq. and Jane his wife the sum of forty pounds for mourning and a ring each. Also I give to each and every of the sons and daughters of the said Matthew and Jane Burchell a mourning ring.

And I do hereby charge and make subject and liable all my Leasehold Estates as well as my personal effects with the payment of the said legacies and especially with the raising the four hundred pounds to be paid out as a fund for the benefit of the said Sophia and George Cobb the elder in the purchase of 5% Navy annuities in manner herein before mentioned.

And as to all the rest and remainder of my estate and effects, both Real and Personal of what nature and kind soever and wheresoever subject nevertheless as aforesaid, I do hereby give, devise and bequeath the same and every part thereof unto my nephew the said George Cobb, the younger, to hold the same to the said George Cobb the younger, his heirs, Executors, Administrators and Assigns for ever.

I do hereby nominate, constitute and appoint the said George Cobb, the younger, sole Executor and trustee of this my said last Will and Testament, in witness whereof I have to the two first sheets put my hand and to the third and last sheet thereof set and affixed my hand and seal, this twenty fourth day of December in the year of Our Lord one thousand eight hundred and fourteen.

Signed, sealed, published and declared by the said Testator Hewett Cobb as and for his last Will and Testament in our presence and who at his request and in the presence of each other have ? hereunto set and subscribed our names as witnesses thereto.

MEMORANDUM this l7th day of January 1822 that I give and bequeath to Mrs. Elizabeth Davy, Widow of John Davy formerly of Acton, Painter, one hundred pounds to be paid to her within 14 (?) months next after my decease and five pounds for mourning to be paid to her immediately and this is a Codicil to the above Will.

PROVED at London with a Codicil l6th February 1822 before the Worshipful Samuel Rush Magister? Doctor of Laws and ? , by the oath of George Cobb the younger, the nephew and sole Executor to whom admon was granted having been first sworn duly to administer.
